End-User License Agreement (EULA)

1. Acceptance of this Agreement
By downloading, installing, or using this application (“App”), you agree to be bound by the terms of this End-User License Agreement (“Agreement”) entered into between you and Cuzzie’s Dispensary & Delivery, LLC (“Cuzzie’s”, “we”, “our”, or “us”). If you do not agree to the terms of this Agreement, do not download or use the App.
2. License Grant
Cuzzie’s grants you a revocable, non-exclusive, non-transferable, limited license to use the App solely for personal, non-commercial purposes in connection with:
– Viewing product menus
– Participating in loyalty and rewards programs
– Placing orders (where permitted)
– Managing your customer profile
– Receiving push notifications
This license is subject to compliance with this Agreement and applicable laws.
3. Restrictions
- Restrictions
You may not:
– Use the App in any jurisdiction where cannabis is illegal
– Use the App if you are under 21 years of age
– Modify, reverse engineer, decompile, or disassemble the App
– Sell, rent, lease, sublicense, or distribute the App
– Use the App for unlawful, harmful, or abusive activities
You represent and warrant that you are at least 21 years of age and legally authorized to use cannabis-related services under applicable law. Cuzzie’s Dispensary & Delivery, LLC reserves the right to require age verification and deny access if such verification fails.
4. Ownership
All rights, title, and interest in and to the App (including all content, features, and functionalities) remain the exclusive property of Cuzzie’s Dispensary & Delivery and its technology partners (including Alpine IQ). This Agreement does not grant you any ownership rights.
5. Loyalty & Rewards Program
Your participation in Cuzzie’s loyalty and rewards program via the App is subject to additional terms and policies, which may be updated from time to time. Loyalty points and rewards:
– Are non-transferable
– May not be redeemed for cash
– Are subject to expiration or revocation at our discretion
6. No Warranty
The App is provided “as is” and “as available”, without warranties of any kind. Cuzzie’s makes no representations or warranties regarding:
– Accuracy or completeness of any content
– Functionality or availability of services
– Fitness for a particular purpose or merchantability
Use of the App is at your own risk.
7. Limitation of Liability
To the fullest extent permitted by law, Cuzzie’s shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to:
– Loss of data
– Business interruption
– Loss of profits
– Personal injury or property damage
8. Termination
This Agreement is effective until terminated. Cuzzie’s Dispensary & Delivery, LLC reserves the right to suspend or terminate access to the App at any time, for any reason, without prior notice. Upon termination, all rights granted to you under this Agreement shall cease.
9. Governing Law
This Agreement shall be governed and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law principles. Any legal action arising out of this Agreement shall be filed in the appropriate courts located in New Jersey.
10. Privacy & Data
Cuzzie’s does not share personally identifiable customer data with third parties. Use of the App is also governed by our Privacy Policy, which outlines how non-personal data and usage metrics may be collected and used.

12. Apple-Specific Terms (if distributed via App Store)
This Agreement is between you and Cuzzie’s only, not Apple Inc. Cuzzie’s is solely responsible for:
– The App and its contents
– Any maintenance or support
– Addressing any claims related to the App
You acknowledge Apple is a third-party beneficiary of this Agreement and may enforce it.
